Privacy Policy

1. This Privacy Policy of the online store www.monpacie.pl (hereinafter referred to as the “Policy”) is addressed to Users and Customers of the Online Store and defines the type, scope and methods of data use, the rights and obligations of users and customers, as well as the protection of personal data. The terms used in this Policy have the same meaning as assigned to them in the Regulations of the online store www.gres.pl, unless otherwise results from the provisions of this Policy.

2. The administrator of personal data obtained from Customers in the Online Store is the Seller, i.e. Monpacie Spółka z Ograniczoną Odpowiedzialnością, with its registered office at: ul. Stawki 2A / 1, 00-193 Warsaw, entered into the register of entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under KRS number 0000989200, NIP: 525-292-11-33, REGON 522947630, with share capital of PLN 5,000 fully paid, phone: 885 187 193, e-mail: biuro@monpacie.pl. On behalf of the administrator, tasks related to the protection of personal data are performed by the Data Protection Officer, who may be contacted in all matters related to the protection of customers’ personal data.

3. The User of the Online Store has the possibility to place an Order in two variants:
1) placing an Order without registration — the User places an Order for Products in the Online Store as a guest, i.e. without creating a Customer Account, providing the following personal data: first and last name, address, postal code, city, mobile phone number, e-mail address, and optionally another delivery address. In the event that the User wishes to receive a VAT invoice documenting the purchase of goods, the User additionally provides the following data: company name under which the business activity is conducted and the address of its registered office, as well as the tax identification number (NIP). Providing the personal data indicated in this section is voluntary, but necessary for the execution of the delivery of the Order;
2) placing an Order with registration of a Customer Account — the User places an Order for Products and registers by creating a Customer Account in the Online Store. During registration, the User provides the following personal data: first and last name, address, postal code, city, mobile phone number, e-mail address, and optionally another delivery address. In the event that the User wishes to receive a VAT invoice documenting the purchase of Products, the User additionally provides the following data: company name under which the business activity is conducted and the address of its registered office, as well as the tax identification number (NIP). Registration of a Customer Account allows subsequent Orders to be placed without the need to re-enter the personal data referred to in this section, as the data provided by the Customer are used for a new Order. Providing the personal data indicated in this section is voluntary, but necessary for the execution of the delivery of the Order.

4. The User may also additionally, during registration of the Customer Account or by entering an e-mail address in the field provided for this purpose in the Online Store, subscribe to the newsletter mailing list of the Online Store.

5. A registered Customer of the Online Store has the possibility to log in via the Online Store website by verifying their identity by providing a Login (the e-mail address indicated during registration) and an individually established Password. It is recommended that the Password consist of a combination of lowercase and uppercase letters, as well as numbers and special characters. The Customer is requested to properly secure the Password against access by unauthorized persons.

6. The personal data of Customers in the Online Store are processed exclusively for strictly defined purposes and within the scope of the granted consent, i.e. for the purpose of fulfilling Orders and enabling the use of the Online Store website, as well as for the purpose of recording sales, subject to cases in which legal provisions allow data processing for specific purposes without obtaining consent.

7. In the event that the User consents to subscribing to the newsletter of the Online Store, their data are used for the purpose of sending ordered messages of an advertising, marketing nature or messages informing about the latest promotions and new Products in the Online Store.

8. In connection with the processing of personal data, the following principles apply:
1) The Customer has the right to request access to their personal data, rectification, deletion or restriction of their processing. The Customer may also withdraw consent to the processing of personal data or raise an objection with respect to data that may be processed without the need to obtain consent. Personal data shall be processed for the period necessary to achieve the purpose of processing.
2) Personal data shall not be transferred to other entities, subject to cases expressly provided for in applicable law, including at the request of authorized entities such as courts and prosecutors.
3) There is a possibility to entrust the processing of personal data to another entity. Such entrustment is possible exclusively on the basis of a personal data processing entrustment agreement ensuring appropriate protection of such data and preservation of the purpose of their processing.
4) Each case of personal data processing must be based on an appropriate legal basis in accordance with applicable regulations, which are the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the “Regulation”.
5) Personal data may be processed on the following legal bases:
1. performance of a contract to which the data subject is a party, or taking action at the request of the data subject prior to entering into a contract — Article 6(1)(b) of the Regulation;
2. compliance with a legal obligation incumbent on the controller — Article 6(1)(c) of the Regulation;
3. protection of vital interests of the data subject or of another natural person — Article 6(1)(d) of the Regulation;
4. direct marketing of the controller’s own products or services — Article 6(1)(a) of the Regulation;
5. pursuit of claims arising from conducted business activity — Article 6(1)(f) of the Regulation;
6. purposes resulting from legally justified interests pursued by the controller or by a third party — Article 6(1)(a) of the Regulation.
7. Adding an e-mail address to the newsletter subscription list of the Online Store is voluntary. The User may at any time change the e-mail address or resign from the newsletter subscription of the Online Store without incurring any additional costs, by contacting the Seller. All contact details of the Seller are provided in the CONTACT section of the Online Store and in the Regulations of the Online Store.
8. The Seller hereby informs that it never asks for the provision of an e-mail address, Login or Password in the content of an e-mail or in any place other than the Online Store, and also does not transfer, sell or lend the collected personal data of Users to third parties, unless with the express consent or at the request of the User, or at the request of state authorities authorized by law in connection with ongoing proceedings.

9. The Seller, as the administrator of personal data, applies technical and organizational measures necessary to protect data as required by the Personal Data Protection Act, in particular secures the personal data of Users, Customers and newsletter subscribers of the Online Store against disclosure to unauthorized persons, loss or damage.

10. The User is requested to immediately notify the Seller of any use of their Customer Account by unauthorized persons or of any other security breaches related to the use of the Online Store identified by the Customer.

11. The Online Store website uses “cookies” which are used to administer the Online Store. Cookies do not contain any personal data. When entering the Online Store, certain information in the form of a “cookie” file may be placed on the User’s computer.

12. Cookies are small files consisting of a string of letters and characters, saved on your computer by a web server when you visit a given website. Cookies are used by the Online Store solely to better tailor the Online Store's website to your individual preferences. Additionally, cookies used on the Online Store website may serve the following purposes:
1) ensuring the proper operation of the Online Store - cookies enable access to certain parts of the website, e.g., those secured by the login system,
2) improving the performance and optimization of the Online Store - cookies enable the collection of information about how Users navigate the website, thus helping to improve it,
3) improving the functionality of the Online Store - cookies enable the storage of information provided by the User, e.g., Login (the session lasts until the browser is closed, after which the cookie is deleted), and shopping cart contents (the session lasts until the browser is closed, after which the cookie is deleted. However, if the User saves the cart, the cookie is deleted 30 days after saving the cart),
4) targeting informational and promotional content - cookies are used to automatically tailor the content of the Online Store to the User's needs.

13. Information collected and generated by cookies on the Online Store website does not allow for personalization or identification of the User. As a result of their use, no personal data of the Online Store User are stored.

14. Cookies are also used by the Google Analytics statistical analysis tool.

15. Cookies used on the Online Store website are safe and do not have a harmful effect on the User’s computer. The User may change the method of using cookies via their browser, including blocking or deleting those originating from the Online Store. In most web browsers it is possible to delete cookie files from the computer’s hard drive, block all incoming cookies or set a warning before saving such files. In order to do so, the User should familiarize themselves with the instructions or help topics of the web browser used. The process of controlling and deleting cookies may differ depending on the browser used. Limiting the use of cookies may affect some functionalities available in the Online Store.

16. The Seller is entitled to introduce changes to this Policy. In the event of changes, the User will be informed at least 14 days prior to the date of entry into force of the changes (appropriate information about changes to the Policy will be posted on the Online Store website, and Users with an active Customer Account will receive information about changes to the Policy by e-mail). In the event of non-acceptance of the amended Policy, the User has the right to terminate the Policy and thus refuse further storage of their data provided during registration on the Online Store website.

17. A change to the Policy, to the extent that its provisions apply to Sales Agreements, does not change the content of Sales Agreements concluded prior to the change of the Policy.
